CELEBRATE 100 YEARS OF ANNE ON PRINCE EDWARD ISLAND

THE 100 YEARS OF ANNE CONTEST (THE “CONTEST”) IS OPEN TO LEGAL RESIDENTS OF CANADA. NO PURCHASE IS NECESSARY. PARTICIPANTS UNDER THE AGE OF MAJORITY IN THEIR PROVINCE OR TERRITORY OF RESIDENCE MUST PROVIDE CONTACT INFORMATION FOR A PARENT OR GUARDIAN AND THAT PARENT OR GUARDIAN MUST CLAIM THE PRIZE ON THEIR BEHALF. VOID IN WHOLE OR PART WHERE PROHIBITED BY LAW. ENTRY IN THIS CONTEST CONSTITUTES ACCEPTANCE OF THESE CONTEST RULES (THE “CONTEST RULES”).

1. ELIGIBILITY. To be eligible to participate in the Contest, an individual must be a legal resident of Canada.

To be eligible to win a Grand Prize (defined below) in the Contest, an individual must:
a. be over the age of majority in their province or territory of residence, or have a parent or legal guardian willing to claim the prize and travel to Prince Edward Island with the winner;
b. be legally able to travel to Prince Edward Island; and
c.be otherwise eligible pursuant to these Contest Rules.

Employees, representatives, or agents of Penguin Group (Canada) (the “Sponsor”), their respective affiliates, subsidiaries, related companies, advertising and promotional agencies, the Jury as defined in Rule 5 below, and the household members and/or the immediate family of any of the above, are not eligible to participate in the Contest. For the purposes of these Contest Rules, “immediate family” means husband, wife, spouse, mother, father, brother, sister, son, and/or daughter, whether or not they reside in the same household.

The Sponsor shall have the right at any time to require proof of identity and/or eligibility to participate in the Contest. Failure to provide such proof may result in disqualification. All personal and other information requested by and supplied to the Sponsor for the purposes of this Contest must be truthful, complete, accurate, and in no way misleading. The Sponsor reserves the right, in its sole discretion, to disqualify any entrant should any entrant at any stage supply untruthful, incomplete, inaccurate, or misleading personal details and/or information.

2. CONTEST PERIOD. The Contest opens at 12:00:01 am ET on February 9, 2008, and closes at 11:59:59 pm ET on April 30, 2008 (the “Contest Period”).

3. HOW TO ENTER.
a. There is no purchase necessary to enter the Contest. To enter, write an original letter to Anne of Green Gables (Anne Shirley) telling her what she means to you. See Rule 5 for the Judging Criteria that will be applied to shortlisted entries. The letter must be 500 words or less, addressed to Anne Shirley or Anne or Anne of Green Gables, and include your full name, Age Category, phone number, email address (if sending letter by email), and mailing address. Entrants under the age of majority in their province or territory of residence must include the name and contact information of a parent or legal guardian.

If entering by email, entrants must include their full name, Age Category, phone number, email address, mailing address, and, if the entrant is under the age of majority in his/her province or territory of residence, the name and contact information of their parent or legal guardian, at the top of their email followed by their letter to Anne Shirley. Letters must be included in the body of the email message. Attachments will not be considered. In the event of a dispute as to the identity of the entrant associated with an email entry, the entry will be deemed to have been made by the holder of the established email account associated with the entry.

b. All entries via regular mail must be postmarked April 30, 2008, or earlier, and received by May 7, 2008. Entries sent via email must be received no later than 11:59:59 pm ET, April 30, 2008. Proof of sending an entry is not proof of receipt by the Sponsor.

c. Limit of one (1) entry per person.

d. All entries become the sole property of the Sponsor and none will be returned for any reason. Entries will be declared invalid if they are late, illegible, incomplete, damaged, irregular, mutilated, forged, garbled, or mechanically or electronically reproduced. No communication or correspondence will be exchanged with entrants except with those selected for a prize.

4. PRIZES.
a. GRAND PRIZES: Four (4) Grand Prizes are available to be won (each a “Grand Prize”). One (1) Grand Prize will be awarded to the winner (as determined pursuant to Rule 5) in each of the following four (4) Age Categories: 10 and under; 11 to 14; 15 to 17; and 18 and older (each an “Age Category”). Each Grand Prize consists of: one (1) CDN$2500 voucher for The Travel Store (www.thetravelstore.ca) to be used only for travel to Prince Edward Island and for any travel product sold through The Travel Store and used on Prince Edward Island; four (4) tickets to Anne of Green Gables: The Musical (if travel dates permit) (approximate value: CDN$200); one (1) family pass to Avonlea Village (if travel dates permit) (approximate value: CDN$45); one (1) copy of signed editions of each of Before Green Gables, Anne of Green Gables Collector’s Edition, and Imagining Anne: The Island Scrapbooks of Lucy Maud Montgomery (approximate value: CDN$89); one (1) 100th anniversary commemorative coin issued by the Royal Canadian Mint (approximate value: CDN$25); and one (1) Anne of Green Gables Collectors package as issued by Canada Post (approximate value: CDN$15). Each Grand Prize has an approximate total value of CDN $2874. Winner is not entitled to monetary difference between actual prize value and stated approximate prize value, if any.

Grand Prizes must be claimed by July 4, 2008, and all tickets must be used, and travel completed, by December 31, 2008. Travel arrangements must be made through Tourism PEI and The Travel Store. In order to make arrangements to claim the travel voucher, the winner is responsible for contacting Tourism PEI at 902-368-5540. If the winner is under the age of majority in his/her province or territory of residence, the winner must be accompanied on any travel by his/her parent or legal guardian. Should the winner be unable to travel before the date set out above, the Grand Prize will be forfeited and no substitute prize will be awarded. Winner and winner’s guests will be solely responsible for any and all expenses not explicitly included in the description of the Grand Prize, including but not limited to travel and medical insurance, additional travel expenses that are not paid for by the CDN $2500 voucher, taxes, gratuities, travel documentation, fuel, ground transportation, meals, beverages, telephone calls, and in-room charges. The Sponsor is not responsible for the inability of the winner or winner’s guests to participate in any aspect of the Grand Prize for any reason whatsoever, including but not limited to lost vouchers or tickets, illness, and travel restrictions.

b. RUNNER-UP PRIZES: Eight (8) Runner-up Prizes are available to be won (each a “Runner-up Prize”). One (1) Runner-up Prize will be awarded to the entrants who come in second and third place in each of the four Age Categories (as determined pursuant to Rule 5). Each Runner-up Prize consists of: one (1) copy of signed editions of each of Before Green Gables, Anne of Green Gables Collector’s Edition, and Imagining Anne: The Island Scrapbooks of Lucy Maud Montgomery (approximate value: CDN$89); one (1) 100th anniversary commemorative coin issued by the Royal Canadian Mint (approximate value: CDN$25); and one (1) Anne of Green Gables Collectors Package as issued by Canada Post (approximate value: CDN$15). Approximate total value of each Runner-up Prize is CDN$129.

c. The total approximate value of all prizes is CDN $12,528.

d. Prizes must be accepted as awarded and cannot be transferred, assigned, substituted or redeemed for cash, except at the sole discretion of the Sponsor. The Sponsor reserves the right, in its sole discretion, to substitute a prize of equal or greater value if any prize (or any portion thereof) cannot be awarded for any reason.

5. WINNER SELECTION.

The Winners shall be selected as follows:
a. Beginning on May 8, 2008, all eligible Contest entries will be sorted into the four Age Categories by the Sponsor or its representative. Sponsor or its representative will randomly select 5 entries from each Age Category to comprise the shortlist. The odds of being selected for the shortlist is dependent on the number of eligible entries received by the Sponsor for your Age Category. Entrants whose entries are shortlisted will not be notified and there is no prize for being shortlisted. After initial random selection, the shortlisted 20 letters will be sent to a jury made up of 5 judges and chaired by the Right Honourable Adrienne Clarkson. The jury is comprised of the Chair, Rogers Fine Print host Carolyn Weaver, bestselling author Roy MacGregor, granddaughter of L.M. Montgomery Kate Macdonald Butler, Scott Anderson, Senior Vice President, Content, from CanWest Global Media, and Robert Waite, Senior Vice President, Stakeholder Relations and Brand at Canada Post (the “Jury”). Each shortlisted entry will be judged by the Jury and awarded points based on the following criteria: 25 points originality; 25 points spelling and grammar; 25 points relevance to subject matter; 25 points style (“Judging Criteria”). Only those letters selected for the shortlist will be judged by the Jury. On [date] at [location and time], using the Judging Criteria, the Jury will select the top three letters in each Age Category and rank the letters from first place to third place. The entrants whose letters are judged to be in first place in their Age Category will be eligible to win a Grand Prize and the entrants whose letters are judged to be in second and third place in their Age Category will be eligible to win a Runner-up Prize. Each selected entrant shall be eligible to win only one (1) prize. The chance of being selected as a potential winner by the Jury from the shortlist depends on how your entry is judged by the Jury based on the Judging Criteria as applied to your Age Category. Before being declared a winner, the selected entrant shall be required to correctly answer a mathematical skill-testing question which shall be administered by telephone, mail, or email by the Sponsor, comply with these Contest Rules, and sign and return the Release (described below).

b. Grand Prize: The Sponsor will attempt to contact entrants selected to be eligible to win a Grand Prize BY TELEPHONE NO LATER THAN JUNE 20, 2008. Entrants MUST RESPOND WITHIN FIVE (5) BUSINESS DAYS OF NOTIFICATION. Upon notification, the selected entrant or, if the selected entrant is under the age of majority in his/her province or territory of residence, the selected entrant’s parent or legal guardian, must respond by telephone to the contact number provided in the notification within five (5) business days of such notification. If the response is not received within that time, the selected entrant will be disqualified and will not receive the Grand Prize or any prize and the process will be repeated in an attempt to award the Grand Prize to the entrant in that Age Category judged by the Jury to have the next best entry. This will be the last attempt made to award the Grand Prize by the Sponsor. The Sponsor is not responsible for the failure of any person to receive the notification described above or for the Sponsor to receive a response.

c. Runner-up Prizes: The Sponsor will attempt to contact entrants selected to be eligible to win a Runner-up Prize BY TELEPHONE NO LATER THAN JULY 7, 2008. Entrants MUST RESPOND WITHIN TEN (10) BUSINESS DAYS OF NOTIFICATION. Upon notification, the selected entrant or, if the selected entrant is under the age of majority in his/her province or territory of residence, the selected entrant’s parent or legal guardian, must respond by telephone to the number provided in the notification within ten (10) business days of such notification. If the response is not received within that time, the selected entrant will be disqualified and will not receive the Runner-up Prize and the process will be repeated in an attempt to award the Runner-up Prize to the entrant in that Age Category judged by the Jury to have the next best entry. This will be the last attempt to award the Runner-up Prize. The Sponsor is not responsible for the failure of any person to receive the notification described above or for the Sponsor to receive a response.

6. RELEASE. To be confirmed as a winner, the selected entrant and his/her guests, if applicable, will be required to complete, sign, and return a declaration and release (“Release”) that confirms winner’s, and winner’s guests’ if applicable: (i) eligibility for the Contest and compliance with these Contest Rules; (ii) acceptance of or participation in the prize as offered; (iii) release of the Sponsor and its parent company, subsidiaries, affiliates, employees, directors, officers, suppliers, agents, sponsors and administrators (collectively, the “Releasees”) and the Jury from any and all liability for any loss, harm, damages, cost, or expense arising out of participation in this Contest, participation in any Contest-related activity or the acceptance, use, or misuse of any prize, including but not limited to costs, injuries, losses related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising therefrom; (iv) grant to the Sponsor and the Sponsor’s related media partner CanWest Media, the unrestricted right, in the Sponsor’s or CanWest Media’s collective or individual discretion, to produce, reproduce, publish, broadcast, communicate by telecommunication, exhibit, distribute, adapt, and otherwise use or re-use the winner’s name, photograph, likeness, voice, biography, and winning letter entry, in any and all media now known or hereafter devised, in connection with the Contest and the promotion and exploitation thereof; and (v) waiver of his/her moral rights in his/her winning entry. The executed Release must be returned within five (5) business days of the date on the cover letter accompanying such form, or the selected entrant will be disqualified and the prize forfeited.

7. INDEMNIFICATION BY ENTRANT. By entering the Contest, entrant releases and holds Releasees harmless from any and all liability for any injuries, loss, or damage of any kind to the entrant, Releasees or any other person, including personal injury, death, or property damage, resulting in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of any prize, participation in this Contest, any breach of these Contest Rules, or in any prize-related activity. The entrant agrees to fully indemnify Releasees from any and all claims by third parties relating to the originality of the entrant’s letter entry and/or the Sponsor’s or the Sponsor’s media partner CanWest Media’s right to reproduce the wining letter entry.

8. LIMITATION OF LIABILITY. The Sponsor assumes no responsibility or liability for lost, late, stolen, misdirected, mutilated, or incomplete entries, notifications, responses, replies, or any Release. Sponsor is not responsible for any technical, hardware, software, or telephone failures of any kind, lost or unavailable network connections, or failed, incomplete, garbled or deleted computer or network transmissions which may limit the ability to participate in the Contest. Sponsor assumes no liability for injury or damage which may be caused directly or indirectly, in whole or in part, from downloading. The Sponsor is not responsible for any incorrect or inaccurate information, whether caused by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the administration of the Contest. The Sponsor assumes no responsibility or liability in the event that the Contest cannot be conducted as planned for any reason, including those reasons beyond the control of the Sponsor, such as tampering, unauthorized intervention, fraud, technical failures, or corruption of the administration, security, fairness, integrity, or proper conduct of this Contest.

9. CONDUCT. By participating in the Contest, each entrant agrees to be bound by the Contest Rules, which will be posted at the Contest Website at 100YearsofAnne.com throughout the Contest Period. Entrant further agrees to be bound by the decisions of the Sponsor, which shall be final and binding on all entrants in all respects. The Sponsor reserves the right, in its sole discretion, to disqualify any entrant found to be: (a) violating the Contest Rules; (b) tampering or attempting to tamper with the entry process; and/or (c) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten, or harass any other person. The Sponsor reserves the right to amend, withdraw or terminate the Contest at any time without prior notice, subject to applicable law and the approval of the Régie des alcools, des courses et des jeux with respect to the province of Quebec.

10. PRIVACY / USE OF PERSONAL INFORMATION. By participating in the Contest, entrant: (a) grants to the Sponsor the right to use his/her name, mailing address, email address, and telephone number (“Personal Information”) for the purpose of administering the Contest, including but not limited to contacting and announcing the winners; and (b) acknowledges that the Sponsor may disclose his/her Personal Information to third-party agents and service providers in connection with any of the activities listed in point (a) above.

By accepting a prize in the Contest, winner grants to the Sponsor and/or CanWest Media the right to use his/her Personal Information and winning entry for the purposes of promoting the 100th anniversary of Anne of Green Gables, and for any publicity or promotional purposes relating to the Contest, in any and all media now know or hereafter devised, including, but not limited to, publication online on any website, in print or on air, without further compensation, unless prohibited by law, and waives his/her moral rights in his/her winning entry. Winner acknowledges that the Sponsor may disclose his/her Personal Information to third-party agents and service providers of any of the Sponsor in connection with any of the activities listed above.

The Sponsor will use the entrant’s and winner’s Personal Information for the purposes identified above.

11. INTELLECTUAL PROPERTY. All intellectual property, including but not limited to trademarks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans, and representations are owned by the Sponsor and/or their affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.

13. LAW. These are official Contest Rules. This Contest is subject to applicable federal, provincial, and municipal laws and regulations. These Contest Rules are subject to change without notice in order to comply with any applicable federal, provincial, and municipal laws or the policy of any other entity having jurisdiction over the Sponsor. All issues and questions concerning the construction, validity, interpretation, and enforceability of the Contest Rules or the rights and obligations as between the entrant and the Sponsor in connection with the Contest shall be governed by and construed in accordance with the laws of the province of Ontario including procedural provisions without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws.

14. FOR RESIDENTS OF QUEBEC. For residents of Quebec, any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.

15. LANGUAGE DISCREPANCY. In the event of any discrepancy or inconsistency between the terms and conditions of the Contest Rules and disclosures or other statements contained in any Contest-related materials, including but not limited to the Contest entry form, or point of sale, television, print or online advertising, the terms and conditions of the Contest Rules shall prevail, govern, and control. In the event of any discrepancy or inconsistency between the English language version and the French language version of the Contest Rules, the English version shall prevail, govern, and control.

16. WINNERS LIST. For a list of winners, send a self-addressed envelope bearing sufficient postage to [address where a request for a list of winner’s can be sent]. Requests must be received by November 7, 2008.
